Brown Appeals Dismissal of EA Suit

jim brown The New York Times has reported that retired football player Jim Brown has filed an appeal in his dismissed lawsuit against Madden NFL publisher EA Games.

A judge ruled in September that EA was exercising First Amendment rights in using a player that resembles Brown and has his jersey number, when Brown sued for trademark infringement in 2008.

The judge, Florence-Marie Copper, died in January, and Brown is arguing against the dismissal.

The Times reported EA Spokesman Jeff Brown said the company is “confident the ruling will be upheld.”

Madden NFL 11 is due to hit shelves on Aug. 10.
