Attorney: ‘We Will Expose All Violations’ of Carter’s Rights

Justin Carter still faces significant hurdles on the road to resolving his perplexing criminal case, but now out of jail for just over 24 hours, his legal defense team confirms they intend to fight hard for his exoneration.

“We’re delighted that [Justin] was able to get out, and we stand ready to fight for his First Amendment rights,” Carter’s Attorney, Don Flanary said today in an interview with Game Front, “[a]nd to expose all of the violations of his civil rights that he was subjected to for the past five months.”

Those alleged violations include not only his arrest for what the defense insists were statements protected by freedom of speech, but Carter’s treatment while in jail. As we detailed in our previous coverage, he was reportedly beaten by other inmates on multiple occasions. But after he became despondent over his open-ended incarceration, Carter was placed under suicide watch where it has been reported that he was subjected to unusual procedures. Normal protocol is for inmates at risk of self-harm to be given padded clothing; according to his father, Carter was forced to go nude.

It was these alleged violations of Carter’s constitutional rights that inspired the anonymous donor who paid Carter’s bond in full. “[The Donor] believes in Justin’s cause,” Flanary told us, and “he believes the illegal detention of him, at such a high bond, was something that he wanted to take action on.” Flanary would not provide any identifying details about the donor, aside from confirming he is male.

Arrested in March for what police say meets the definition of a terroristic threat under Texas law, Carter faces up to 10 years in prison, and $100,000 in fines if he is convicted. Carter’s next court date is a pretrial hearing scheduled for August 12. At that time, his legal defense team intends to file for dismissal on first amendment grounds. As for Carter himself? “He’s much better now that he’s out, he’s in good spirits,” Flanary said.
