Nintendo Issued Court Order to Forfeit 1.82% of 3DS Sales

A US judge has ruled that Nintendo has been using patented camera technology without permission, and as a consequence, must forfeit 1.82 percent of 3DS sales in perpetuity.

“Nintendo must pay [the patent holding company] Tomita 1.82 percent of the wholesale price” on every 3DS sold from now until the end of the handheld’s life.

3DS sales have been the silver lining on Nintendo’s cloud of doom and gloom, and the 1.82 percent comes out to a loss of up to $3 for every unit sold. After poor Wii U sales, the 3DS was Nintendo’s hope for the future. Having sold 2 million 3DS and 3DS XL units last quarter, and with current lifetime sales estimates totalling 35 million, Nintendo could face to lose approximately $100 million to this lawsuit.
