Well, some, anyway...

The short, brutal life of APB (and developer Realtime Words) recently ended, with consumers seemingly unable to reclaim whatever investment they put into the MMO. However, despite not receiving refunds, consumers are reportedly obtaining compensation in other ways.

Gamasutra and Dtoid both report that players have been offered a discount or free game after contacting EA's support line. According to the administrators behind Realtime Worlds' bankruptcy, consumers should contact the retailers from which they purchased the game in order to pursue "entitlement to any refund."

Now, I didn't want to resurrect the other thread as what I'm asking is unrelated. Should Realtime Worlds/EA be allowed to do this? Or should they be obligated to compensate players that purchased the game? What are your opinions on developers/service owners simply terminating the service without notice?

Personally, I don't think they should be obligated to do anything. When users sign up for a service such as that, there's always a paragraph somewhere in the Terms of Service/End User License Agreement stating the service or access to the service may be terminated at any time. Some people would call this unfair treatment of customers, and even borderline illegal. I'll agree on the first point, but not the second. If people signed the EULA, they agreed to the terms in that document.

They have no legal obligation to do anything, but in my eyes, it's the right thing to do. And from the standpoint of the developer, publisher and distributor, it could certainly be a good way to save some face in the eyes of the public, to give the impression that they give a shit about their customers.

I think the most important thing for them to do with any money they have left is to make sure their employees are paid redundancy cheques as much as possible. Any money left after that can certainly go towards compensating their customers, though they are under no obligation to do so.

An awful lot of what's in agreements you sign is simply unenforceable. At least in the UK you have rights that you cannot give up entirely to prevent people from creating ludicrous agreements and levering you into them through market forces.

:agreed

They could have done nothing or told people to "fuck off" if some people asked for refunds. They have the right to do the latter, but they decided to do the opposite which is the right thing morally.

EA isn't making a lot of money right now, so they can't afford bad PR and could use some consumer kudos.
