Sue! Sue! Sue! Sue 'em for a million bucks!

We all know that walking and texting is a tough combination -- but a Staten Island teen learned the hard way when she fell into an uncovered sewer manhole while trying to send a message.

Now, the family of Alexa Longueira, 15, intends to sue.

The girl suffered a fright and some scrapes on her arms back after she dropped into the hole on Victory Boulevard.

"It was four or five feet, it was very painful. I kind of crawled out and the DEP guys came running and helped me," Longueria told the Staten Island Advance.. "They were just, like, 'I'm sorry! I'm sorry!"

For its part, the Department of Environmental Protection said its workers had turned away briefly to grab some cones when the incident occurred.

"We regret that this happened and wish the young woman a speedy recovery," DEP spokeswoman Mercedes Padilla said in a statement. She added that crews were flushing a high-pressure sewer line at the time.

The girl was checked out at Staten Island University Hospital and released.

Sewer line workers are supposed to cut off pedestrian access to work sites or at least mark them with warning signs.

The family said they will file a lawsuit -- for what, though, is not immediately clear. Her mother, Kim Longueira, said it doesn't matter that her daughter was walking and texting, and also, the 'gross' factor that can't be ignored.

"Oh my God, it was putrid," she said. "One of her sneakers is still down there"

Her fault for not watching where she was going and the Workers falut for not putting ah what do you call those? I wanna "Road Blocks" For the manhole...

Absolutely her fault, even in our putrid legal system, she wouldn't win. And, in my opinion, she deserved it.

Maybe I'm just too used to the Nordic manholes, but aren't they usually placed in the middle of the road to prevent this stuff from happening? I've never seen a manhole anywhere but on asphalt.

I think both parties are at fault; the construction people should've blocked pedestrian access as stated and the girl should've been paying attention.

Not really sure where I stand on the sueing thing,

They are in the main streets, but are common on sidewalks as well. Only thing it says is that it happened on Victory Boulevard, which I would presume is the street. I hope it wasn't though, as it would be an even more incredibly stupid incident to be walking in the main street not paying attention to where you were going.

They should have put out cones to block traffic BEFORE they removed the manhole cover. I think it's fair to blame the construction workers in this case. You can't expect people to just stare straight ahead in front of them the whole time they are walking. There's no reason the person that fell in couldn't have just been looking at something, answering their phone, talking to someone next to them, or any of a number of other things people do all the time while walking. I don't see why the fact the girl was texting suddenly makes it her fault.

People walkig under busses and other vehicles, into walls and other objects, off the edge of object, into other people and so on... not watching your step for a moment, alright but your main focus while walking should be where you are putting your feet (ea watchign what is right infront of you on your intend walking path).

There is a big difference between walking in front of a large, loud moving object and stepping into a relatively small, unmarked hole. People can't stare at their feet the whole time they are walking, that is why manholes are always marked before being removed for any reason. She probably would have noticed even a single orange cone.

They really shouldn't sue. It was the fault of the girl for not noticing an open manhole in front of her. Though the workers are partially to blame...I think she deserved it.
