She's been charged with careless driving because she got in a single vehicle crash on a steep road, that was icy, and durning a rainstorm. Nobody got hurt, but it's still a misdemeanor. She was obeying all the laws of the road, and she was going as slow as she could. It's not easy with a 4 ton trailer behind you. So, is the justice system dishing out bullshit again, or is it just me?

It's stupid there's no doubt about that, but truckers are fined for the actions of their vehicles. They are written a ticket when the brakes fail and it becomes a runaway as well, even if no one was injured or harm done because the driver lost control of the vehicle.

Well, actually, I think this is fair. A 4 ton trailer could do some serious damage to another vehicle. The driver has a responsibility to gauge the road, and her skills, and keep the vehicle under control. If she cannot, then result could be disastrous.

Sure, Hindsight's 20/20, but this way your mom is less likely to risk driving in such conditions next time. As next time, it may not be a single vehicle accident.

I'm really not to sure about this. As Monster says, a large and heavy trailer can do some serious damage if it goes out of control. Just because it doesn't do any harm doesn't necessarily mean allowing it to get out of control shouldn't be punished. Think about it like drunk driving. Not every drunk driver ever has crashed into and killed someone, but the risk is high enough that we've outlawed it.

The risk of a big ol' trailer going out of control has also apparently been deemed dangerous enough to outlaw allowing such a thing to occur. Part of being in command of a dangerous tool is knowing when not to use it, or when it is out of your league. The fact that your mother choose to go up an icy, steep incline during a rainstorm is, in fact, the dangerous part of what she did. She put herself into an incredibly dangerous situation, and I would imagine she could have pulled off to the side of the road and waited for the storm to pass.

Should she have a criminal record because of it? I don't really think so, if anything she should have gotten off with a warning, assuming first offense, or been given a traffic ticket. Actually being charged with a criminal offense seems a bit much.

All that said, the U.S. legal system is still fubar.

My mom is on the meth watch list in Indiana, because she orders all of her lye for soap from some plant there.

There's an argument that driving in those sorts of conditions in that kind of vehicle to start with qualifies as careless driving.
