13th_Blade;3689176If he does go for a full project, he'll have a C&D slapped on him by Square-Enix, and if he doesn't comply and finishes the project, he could be taken to court and sued for copyright violation. Hence why the last three KH mods were all shut down when the inevitable C&D came.... how can I be fined? Im not copying writing anything... I can create my own story 4 it without any trouble because its no where close 2 the real game. This is just made up by a person... + If this is a copy write issue then why do model creators who create models from other games such as Roxas or riku not get fined? that is copying writing because I know 4 sure that a company would not allow it. So if others are able 2 create there own models of these players in other games... why cant we create are own story? (Im just asking because Im not trying 2 brake any rules or copywrite isues Im just having a little fun making my own story.)
Because you are using someone elses intelectual property. squeenix are a very finicky company. sometimes they allow things and sometimes they don't. Although i'm sure they aren't too happy about people making replicas of their characters (because doing a bad job would reflect badly on their design), they realise that it's a difficult issue to control, and that they couldn't really do much to stop it. however, creating what is essentially an entire game, based on their own intelectual property (using you own story or not, the entire KH WORLD is owned by them), puts you in a bad position, and them in a worse one: if they allow you to continue, and you make a full blown "mod" which could take hours and hours to complete, but you did a bad job of it, you can hurt their franchise. you would make them and their designs look bad. if you did a good job, you could make squeenix look bad by being better than them. either way, you have the potential to damage their sales. which puts you in a financially liable position. they can extract an amount, from you, which they believe accurately reflects both your threat to their potential sales (i would estimate in the hundreds of thousands), as well as the original copyright breach by using their design (you're looking at an awful lot more here). good luck  for the record, the chrono trigger remake i was working on was shut down years ago by squeenix. they also asked me to stop modeling sephiroth at one point, believing i was intending an FFVII remake. they allowed me to continue when i signed a piece of paper saying i would never try to recreate any of their titles again =/
wow.....squeenix are bit competitive aren they lol well i hope this mod goes well i kinda been waiting for soemthing like this come around
Inyri Forge;3689369That's not really true. Any game developer can complain and has a legal leg to stand on if you use any of their IP. It doesn't have to be a direct recreation or ported.
This is also true, Konami USA contacted me on my Castlevania mod, and formly requested the name was changed or face legal charges. in complance with Konami, this change has been made and other alterations to make it less Castlevania.
Then why are you still promoting it as a Castlevania project? The way you're currently going, they could sue you tomorrow and you wouldn't be able to do a thing about it.
I don't know how, and I don't know why, but this is totally Sheep's fault.
i was refering to it as in its original form. since we haven't released a final name as of yet.
gee... they actually contacted you people...? I wish Tecmo would answer my e-mails xP
yeesh why do they always bother people saying they will so them they always find a way to get money and how do they know that you make that they spy on people or what?
LordNosferatuAlucard;3690550yeesh why do they always bother people saying they will so them they always find a way to get money and how do they know that you make that they spy on people or what?
1: I can't understand you. 2: Punctuation marks, among other things, work wonders. 3: If you're saying what I think you might be saying, read Kouens post and you might understand.
