Can someone tell me if i should get rid of this, it seems to be messing with spybot search and destroy.

I've never seen that happen before in Spybot.

I'd recomend booting into safe mode, and seeing if the problem persists.

In other words, it's in use (in the system memory).

Boot up to Safe Mode like MM said, and then do a scan.

looks like an infected ini file that is being use, probably best to disconnect the internet. and run in safe mode.

.ini files don't access the internet, they are config files, which are more commonly replaced by registry entries. It's probably made changes to your Operating system that you are unaware of. Get rid of it, any way possible.
