[size=-1]CATHERINE WILSON[/size] [size=-1]Associated Press[/size] MIAMI - An HIV-infected child pornographer was sentenced Friday to 100 years in prison for recording his sex acts with at least 120 children as young as 7 in Cuba and Ecuador and distributing videotapes and CDs to at least 300 U.S. customers.
U.S. District Judge Cecilia Altonaga, who heard the trial of Angel Rafael Mariscal without a jury, borrowed from the remarks of another judge when she said the crimes were so morally reprehensible "that it gravitates at or near the bottom rung of human behavior."
After Mariscal's arrest at a Miami Beach hotel, the Ecuadorean national "rather defiantly told me, 'You'll never find the victims,'" former U.S. Postal Service lead investigator Elizabeth Bendel testified.
He was proved wrong. The Cuban government cooperated with U.S. investigators and tracked down nine victims using nonpornographic still images lifted from the porn tapes and disks. Cuba prosecuted three women and a man who helped recruit girls and boys for the illicit productions. Ecuador identified three victims.
At sentencing, the judge watched excerpts from about 10 tapes as a pediatrician with expertise in child abuse estimated from their sexual development that eight victims were under age 12 and 13 more were under 16. Mariscal, 45, did not watch the tapes and busied himself writing notes.
"It was difficult to watch," she said, adding it was hard to keep from leaving the courtroom. Noting the girls were poor and paid off with offers of a bicycle, clothing or small amounts of cash, the judge said, "These are vulnerable victims, by any stretch of the imagination."
She took pains during the trial and sentencing hearing to make sure the pornographic images were not publicly disclosed. But she mentioned expressions of pain or discomfort on the faces of some of the young girls during intercourse and use of a dog collar and leash on victims.
"You saw so many victims that it is difficult to count," prosecutor David Szuchman said. "When he went to these countries and abused these poor kids, he knew he was HIV positive."
Mariscal allowed customers to order custom videos made to their specifications for as much as $975 per film, investigators said. The judge said he was able to "perfect the business" as actor, producer and distributor by preying on poor children on his regular travels to foreign countries.
With federal sentencing rules in legal flux, Altonaga sentenced him three different ways and came up with the same 100-year result each time, agreeing with prosecutors that the crimes were "heinous, brutal, cruel and degrading."
Mariscal spoke at length as he asked for something short of a life sentence, saying he doesn't have long to live because he tested positive for HIV in 1994. He said he became a sex addict after coming to the United States in 1980 and blamed easy access to porn in New York's Times Square.
"I am not a freak of nature. I'm just an average guy," he said. "Addiction to pornography is not something society is willing to accept."
After two years away from pornography, he said he knows how damaging his addiction was.
"When I was engaged in sexual activity with these girls, I really thought I was somehow helping them," he said. "I knew it was illegal. I didn't think it was wrong."
But he denied sexually penetrating "the younger victims" and insisted he did not intend to infect the children with HIV. None of the 12 children who have been tracked down tested positive for HIV in their initial exams, which Mariscal said proves that his use of soap and water, mouthwash and in some cases gloves was effective in preventing transmission.
But Szuchman said the victims now face a lifetime of fear and HIV testing.
Investigators believe Mariscal was in the child porn business for 10 years. Agents tracked Mariscal to a storage facility, where they uncovered 500 videotapes, customer lists of 300 people and photo equipment. With the huge volume of porn in hand, federal agents set up a mail-order sting and filled fresh orders.
The probe evolved into Operation Lost Innocence, which so far has resulted in 107 search warrants served, 44 arrests, 26 convictions and three suicides. Defendants include police officers, teachers, a fire department lieutenant, a college professor, school custodian and school bus driver.
Defense attorney David Hodge, who plans to appeal, acknowledged: "It's a horrible crime. It's a sad crime."
